According to TMZ, artist Andy Stone filed a lawsuit against the five-time Grammy winner, claiming copyright infringement, 28 years after she released the Christmas jingle in 1994.

The lawsuit names Mariah Carey and her co-writer Walter Afansieff. It was filed by songwriter Andy Stone.

Carey released the song in 1994 as part of her album Merry Christmas, and it has since become one of the most well-known festive hits.

Mr Stone claims in legal documents filed in the US District Court for the Eastern District of Louisiana that he co-wrote the song in 1989 and has never given permission for it to be used.

According to the documents obtained by the PA news agency, Carey and her associates “knowingly, willfully, and intentionally engaged in a campaign” to violate Stone’s copyright for the song.

They also claimed that the defendants had committed “acts of unjust enrichment through the unauthorised appropriation of plaintiff’s work and the goodwill associated therewith.”

Stone is suing for $20 million (£16 million) in damages.
